Croatia has one of the most comprehensive parental rights systems in the region. The Act on Maternity and Parental Benefits governs maternity leave, parental leave, and associated benefits.
The mother is entitled to maternity leave of 98 days – up to 28 days can be taken before the expected due date and the remainder after birth. A minimum of 70 days after birth is mandatory and cannot be transferred to the father. The maternity leave benefit equals 100% of the average gross salary from the previous 6 months, paid by HZZO, subject to an annual cap.
After maternity leave, both parents can take parental leave for a combined total of up to 1 year (or 2 years for twins and third+ children). Each parent has 2 non-transferable months (the "father's quota"), encouraging active paternal involvement. The benefit equals 100% of average gross salary for the first 6 months taken by one parent (with a cap). Employees on parental leave have the right to return to the same or equivalent position.
Employees enjoy full dismissal protection during maternity and parental leave. The Labour Act explicitly prohibits termination of a pregnant employee or one on maternity/parental leave. Upon return, the employee has the right to the same working conditions (salary, position, benefits) as before. Adoptive parents and guardians also have these rights.
Yes. In Croatia both parents can use parental leave, alternately or simultaneously (as reduced working hours). Each parent has 2 non-transferable months, with the remainder being flexible.
Yes. Self-employed persons (sole traders, freelancers) who are enrolled in mandatory health insurance are entitled to maternity and parental benefits from HZZO, provided they have been paying contributions regularly.
Yes. One parent may use parental leave through half-time work, effectively doubling the leave period, with the benefit paid at 50% of the full amount.
